BAIL APPLICATIONS

POLICE BAIL:

In terms of the Criminal Procedure Act (Act 51 of 1977) the attorney of a person charged with any of the crimes listed below can arrange with the investigating officer for the person to be released on bail before his first court appearance.

 

The police may determine bail for the following crimes:

​

• Drunk driving;

• Contravention of Covid-19 restrictions;

• Assault;

• Theft, where the value of the stolen goods is less than the prescribed minimum;

• Crimen iniuria (culpable defamation);

• Possession of a small amount of dagga;

• Reckless or negligent driving;

 

For more serious offence either the court or prosecutors bail will be required, we may still get you out on the same night if your crime allows for prosecutors bail.  Court bail will only be applied for on the first court day after your arrest.
